What’s New in the 2026 Illinois Residential Lease

The 2026 Illinois Residential Lease includes several important updates designed to enhance compliance, clarity, and tenant protections:

  • New Required Disclosure – Summary of Rights for Safer Homes Act
Effective January 1, 2026, Illinois law now requires all residential leases—both new and renewal—to include a Summary of Rights for Safer Homes as the first page of the lease. This disclosure ensures tenants are informed of housing protections available to victims of domestic or sexual violence, supporting safer housing and greater financial security.

  • Optional Tenant Brokerage Compensation Terms
The lease now allows for negotiated tenant brokerage compensation. When applicable, these terms are clearly addressed through a new Brokerage Compensation section, providing transparency for all parties.

  • Expanded Additional Agreements Section
Formatting updates include a larger, more flexible write-in area for Additional Agreements and Covenants, allowing for clearer customization and fewer ambiguities.

  • Updated Rules & Regulations – Smoking Policy
A new standard rule has been added prohibiting smoking within the property unless expressly authorized in the lease, aligning with modern property standards and owner preferences.

At Bradford Miller Law, we integrate these updates into all lease agreements to ensure compliance and transparency. We recommend adding tailored protective clauses in an appendix to address unique needs. The 2026 Chicago Residential Lease is a vital resource for all landlords in the city.
